LHC petition seeks removal of Caretaker CM Punjab from office

On Saturday, a civilian petitioned the Lahore High Court (LHC) to dispute the tenure of caretaker CM Punjab, Mohsin Naqvi. Petitioner Latif Chaudhry has petitioned the court to prevent Caretaker CM Punjab Naqvi from remaining in office after his term expires.

The petition’s respondents include the caretaker CM, the election commission, and others.

According to the petitioner, the caretaker government’s mandate in Punjab has expired in accordance with the constitution. “The Supreme Court extended the provincial election date but did not extend the caretaker government’s term.”

“Caretaker CM Mohsin Naqvi is holding the office in an unconstitutional manner.”
The continuation of the chief minister and his cabinet in office is a clear breach of the constitution, according to the petition.

“All orders and actions taken by the caretaker government following its 90-day term are unconstitutional.”

The petitioner requests that the court issue an order removing Caretaker CM Mohsin Naqvi from office immediately and preventing his temporary government from functioning.

“The court should also order the election commission to issue a notification for the new caretaker government in the province,” the petition states.

Sibtain Khan, the Speaker of the Punjab Assembly, had stated that he would petition the Supreme Court to remove the caretaker government.

In a statement, Sibtain Khan stated that the caretaker administration had served its 90-day term and had lost its legal mandate. He went on to say that they would approach the Supreme Court to seek alternate arrangements for Punjab.

Khan stated that the caretaker regime in Punjab will be terminated on April 22 following the expiration of its constitutional duration.
